These terms apply to this website and to the applications published by Lakunella LLC (“Lakunella”, “we”, “us”). By using them, you agree to these terms. If you do not agree, please do not use them.
Using our services
You may use our website and apps for their intended purpose. You agree not to misuse them — that includes attempting to break, overload or gain unauthorised access to our systems, reverse engineering our software except where the law expressly allows it, or using our services to break the law or infringe someone else’s rights.
Accounts
Where a service requires an account, you are responsible for keeping your credentials secure and for activity carried out under your account. Tell us promptly if you believe your account has been compromised. We may suspend or close an account that is being used in breach of these terms.
Your content
Content you create using our software remains yours. We claim no ownership of it. Where a feature requires us to store or transmit your content in order to work — sync or backup, for example — you give us the limited permission needed to provide that feature, and nothing more.
Our content
The software, this website, and the names, logos and designs used in them belong to Lakunella LLC or its licensors and are protected by intellectual property law. Using our services does not transfer any of those rights to you. Third-party components we include remain under their own licences.
Purchases and subscriptions
Where an app is paid, or offers purchases or a subscription, the price, billing period and renewal terms are shown before you buy. Purchases made through a platform’s store are handled by that platform, and its refund and cancellation rules apply. You can manage or cancel a subscription through the store account you bought it with.
Availability and changes
We work to keep our services available and up to date, but we do not guarantee uninterrupted service. We may add, change, or discontinue features, and we may stop offering a service. Where a change is significant, we will give reasonable notice through the app or this website.
Third-party services
Our services may link to or interoperate with services we do not control. We are not responsible for their content, terms or privacy practices.
Warranties and liability
Our services are provided “as is”, without warranties of any kind beyond those that cannot be excluded by law. To the fullest extent permitted by law, Lakunella LLC is not liable for indirect, incidental or consequential losses, or for lost data or lost profits. Nothing in these terms limits liability that cannot lawfully be limited, and where you deal with us as a consumer, your statutory rights are unaffected.
Termination
You may stop using our services at any time. We may suspend or end your access if you breach these terms or if we are required to do so by law.
Privacy
Our handling of personal information is described in our Privacy Policy, which forms part of these terms.
Changes to these terms
We may update these terms. The date at the top of this page shows when they last changed. Continuing to use our services after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict of law rules, and the courts of that jurisdiction have non-exclusive jurisdiction over any dispute. If you are a consumer, you keep the protection of any mandatory rules of the country in which you live.
